Appeals court grants Kingsmen royalties from hit ‘Louie Louie’

SAN FRANCISCO (AP) — "Louie Louie" made money money, but the Kingsmen haven’t received any royalties for at least 30 years. A federal appeals court ruled yesterday the band should.

The band that recorded the hit version of the rock standard in 1963 signed a contract in 1968 that was supposed to provide the members with 9 percent of the profits or licensing fees from the record.

They never got a cent, said the 9th U.S. Circuit Court of Appeals. In 1993, the Kingsmen, some of whom are still on tour, sued Gusto Records and GML, who held the rights to the recording. A federal judge rescinded the contract, granted the musicians the right to all royalties from the time they sued and held the companies in contempt when they refused to surrender the master recording.

In a 3-0 ruling, the appeals upheld the judge’s decisions in favor of the Kingsmen.

"I’m thrilled for the band that they’re finally going to get what is due to them," said Jeanette Bazis, a lawyer for the five members of the group who filed the suit. She said the Kingsmen, including three of the original members, performed Thursday night to a sellout crowd in Minneapolis.

Bazis said recent sources of royalties include the movie "Mr. Holland’s Opus," the television show "3rd Rock from the Sun," Coca-Cola commercials and compilation albums.

Total royalties due since 1993 are in the hundreds of thousands of dollars, said Scott Edelman, another lawyer for the Kingsmen.

"Louie Louie," written by rhythm-and-blues artist Richard Berry as a Jamaican love song in 1955, has been recorded more than 1,000 times. The hit version, by the Kingsmen in 1963, featured Jack Ely’s almost-incomprehensible lead vocal — shouted into a microphone 12 feet above his head in a primitive studio.

Rumors on high school campuses that the lyrics were obscene prompted a federal investigation, which concluded that the words were unintelligible at any speed. Berry’s actual lyrics, sung by Ely, were a sailor’s lament to a bartender named Louie about his lost love and contained not a hint of impropriety.

Berry sold the rights to all his songs for $750 in 1956 but got $2 million in royalties for "Louie Louie" 30 years later with the help of an artists’ rights group. The Kingsmen’s contract was supposed to give them a percentage of the profits from their version, which has been included in various revival records and films over the years.

The court said it was undisputed that "the Kingsmen have never received a single penny of the considerable royalties that ‘Louie Louie’ has produced over the past 30 years."

It was also undisputed that the companies sued by the band "have breached their agreement repeatedly," the court said.

Wednesday, July 9, 2003 - Albuquerque Journal

By Paul Logan, Journal Staff Writer
Lee Francis, a nationally known Laguna Pueblo author, was a "central force" in the encouragement of young Native American writers, a friend said Tuesday.

Francis, winner of the 2003 Excellence in Literary Arts Bravos Award, died Monday of cancer at his Albuquerque home. He was 58.

Francis was a University of New Mexico associate professor and founder/national director of Wordcraft Circle of Native Writers and Storytellers.

Francis was a nonjudgmental person who was generous with his advice and his spirit, said Joseph Bruchac, an Abenaki Indian writer from Greenfield Center, N.Y.

"I would say in the last 10 years in particular, Lee has been a very central force in the encouragement and the advancement of young native writers," Bruchac said.

"In many ways, Lee was an example of what a teacher should be. He taught what he loved, and he taught it in such a way that it inspired those people who were lucky enough to experience his tutelage."

His son, Lee Francis IV of Albuquerque, said his father loved Wordcraft Circle, which he founded in 1992. "It was family."

His Wordcraft "family" has about 300 members from around the world, including 135 indigenous nations and tribes.

"I think that's why he always focused on family," his son said. "He came from a big, strong family core himself ... It's about folks getting together and sharing ideas, sharing support and love and all of the wonderful things that comes from being part of a family."

Elias Lee Francis was born in Albuquerque to a Laguna-Scotch mother and Lebanese father. Francis was a barrel-chested 5-foot-10 and about 240 pounds with black, curly hair.

"He was thoughtful and always inquisitive about human beings in general," his son said.

He said the Arts Alliance's award in April was "such an incredible honor" for his father, especially in his home state.

During the presentation at the Marriott Hotel, there was a video about Francis. The filming was done before he began losing large amounts of hair because of chemotherapy. So Francis shaved his head.

His son said his father told the audience: "Well, if you couldn't tell already, I have a new hairstyle."

"He was funny and he just gave off an energy that people wanted be around," his son said.

Francis taught at UNM since 1997. His field was Native American Studies, where he was an expert in literature, both oral and contemporary.

He wrote "Native Time: A Historical Time Line of Native America" in 1996. He co-authored "Reclaiming The Vision — Past, Present and Future: Native Voices for the Eighth Generation" in 1996.

His first book of poetry, "On the Good Red Interstate: Truckstop Tellings and Other Poems," was published in 2002.

Francis was compared to a number of great Indian writers in a Journal feature announcing his award. In the story, Francis expressed elation about the blossoming of Native American writing:

"What's especially exciting is that young students in high school, of their own accord, are talking about the importance of writing and how it dramatically impacts, particularly Native American societies and cultures.

"It's important for the young to become articulate and to write their stories. For me, it's very inspiring..."

Bruchac said Francis inspired others, and yet always gave the people credit without indicating what he had done.
"There are a lot of talented people in the world, but not a lot of people in the world who encourage the talent of others," Bruchac said of Francis.

He called Francis' loss incalculable, but he hoped someone would fill the vacuum.

"On the other hand, someone like Lee never really leaves us," Bruchac said. "I know that he'll always be with me and my family."

Other survivors include Mary, his wife of 31 years.

A service will be held at 10 a.m. Friday at the UNM Alumni Chapel on campus, a short distance west of the duck pond.

Memorial donations may be made to Wordcraft Circle, 4905 El Aguila Place NW, Albuquerque, N.M. 87120.
